Trading Terms and Conditions
Yahweh Promotional Garments (Pty) Ltd Registered in South Africa
These Trading Terms and Conditions (“Terms”) govern all sales, supply, and delivery of goods by Yahweh Promotional Garments (Pty) Ltd (“the Company”) to any purchaser (“the Customer”). By placing an order, the Customer agrees to be bound by these Terms, which are enforceable under South African law.
1. Orders and Communication
Orders may be placed via online portal, email, WhatsApp, or fax.
The Company undertakes to maintain proper communication channels at all times.
Acceptance of an order is subject to written confirmation by the Company.
2. Stock Availability
All deliveries are subject to stock availability at the time of order.
Customers are required to confirm availability prior to placing orders.
The Company reserves the right to amend or cancel orders where stock is unavailable.
3. Product Quality
The Company warrants that goods supplied meet reasonable quality standards.
Garments made of cotton or partly cotton is not suitable for excessive exposure to sunlight or perspiration, and fading may occur.
The Company shall not be liable for fading or deterioration arising from such exposure.
4. Pricing and Payment
Prices are subject to change without prior notice and may fluctuate in line with Rand/Dollar exchange rates.
Payment terms are strictly as agreed upon invoice.
Overdue amounts shall attract interest at prime lending rate + 2% per annum.
Discounts granted are conditional upon timely payment and may be reversed if payment is not made as agreed.
Title to goods shall remain vested in the Company until full payment is received.
5. Delivery and Inspection
Delivery shall be deemed complete upon receipt of goods by the Customer.
Customers must inspect goods immediately upon delivery.
Any discrepancies with the Purchase Order, Tax Invoice, or Delivery Note must be reported in writing within 24 hours of delivery.
Failure to notify within this period shall constitute acceptance of goods.
6. Returns Policy
Returns will only be accepted in accordance with the Company’s published returns policy.
Customers are required to review the returns policy prior to placing orders.
Goods returned without prior authorization will not be accepted.
7. Risk and Ownership
Risk in goods passes to the Customer upon delivery.
Ownership remains with the Company until all amounts due are paid in full.
8. Jurisdiction
These Terms are governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of the courts of KwaZulu-Natal, South Africa.
